TERMS AND CONDITIONS
Eligibility and Agreement Acceptance:
You must meet the following eligibility criteria to participate in the loyalty program:
Possess and maintain a valid driver's license issued in Australia or their home country.
For international driver's licenses not issued in English, customers must provide an officially translated copy in English.
Provide a valid copy of their passport for identification purposes
Provide valid contact information as required by the company.
Rental Period:
The rental period commences on the date of motorcycle delivery and continues until the full ownership transfer takes place, subject to the payment terms mentioned in a separate contract.
Ownership Transfer:
Ownership of the motorcycle will be transferred to you upon completion of the agreed payment terms outlined in the separate contract.
Maintenance and Repairs:
You are responsible for ensuring the regular maintenance and servicing of the motorcycle.
MotoPapi will carry out necessary servicing and maintenance at scheduled intervals during the rental period free of charge.
Repairs resulting from normal wear and tear will be covered by MotoPapi.
Repairs necessitated by damages caused by improper use and operation of the vehicle, accidents, or negligence will be your responsibility.
You should promptly report any issues or required repairs to MotoPapi to ensure timely resolution.
Improper use includes but is not limited to, reckless driving, participating in races, overloading, or using the motorcycle for purposes other than its intended use.
Any repairs required due to improper use will be billed to you, and the terms of the loyalty agreement may be affected.
Insurance:
The motorcycle will be covered by compulsory third-party insurance provided by MotoPapi during the rental period.
MotoPapi will cover the insurance fees associated with the insurance coverage.
DAMAGE/ACCIDENT:
You are responsible for all costs of any description, including all applicable insurance excesses arising out of damage to or loss of the motorbike or any equipment, together with the cost of any damage caused by you to a third party. You are also responsible for all recovery costs (i.e., towing, salvage), and any recovery costs incurred by you will be additional to any damage excess we charge.
If damage is caused by the misuse or abuse of the motorbike in our opinion, or you are in breach of these Terms or the Rental Agreement, you will be liable for the Rental Charges for the remainder of the unexpired hire period, together with all repair costs, replacement parts, and recovery of the motorbike.
In the event you are involved in an accident, you must obtain details of all parties involved, including name, address, driver's license numbers, and insurance details (if they are available). You agree to provide all assistance reasonably required, including the provision of statements or documents. You will attend court to give evidence as required and meet with our lawyers in relation to any legal action arising in connection with your rental of the motorbike.
Regardless of the circumstances of the accident, you will not admit liability to any other parties of the accident for any reason.
You must notify the police if required under the relevant road rules.
You must not leave the motorbike unattended before the arrival of a tow truck or salvage operator except if your health or safety would otherwise be endangered.
You must complete and return an Incident Report Form, which we will provide to you.
You are responsible for the cost of tire replacement in the event of a puncture or any damage outside wear and tear.
loss damage waiver:
You are liable for:
Loss of and all damage to the motorbike and;
All damage to the property of any person, which is caused by you or any person that you allow to ride the motorbike,
or is caused by the use of the motorbike by you or any person that you allow to ride the motorbike.
Subject to the terms of this waiver, we will waive your liability for damage to, or loss of, the motorbike and will ensure that you and any Authorized Driver are entitled to be indemnified under our Insurance Policy with the full payment of the Excess amount for each separate event involving:
Damage to, or loss of, the motorbike; or
Damage to the property of any third party which is caused by the use of the motorbike by you or any person that you allow to ride the motorbike.
Additional amounts payable:
In addition to the waiver, you must always pay us the following costs and fees, including the cost of repairing or recovering any:
Water damage to the motorbike;
Damage to the motorbike or to the property of any third party caused by a breach of this rental agreement;
Damage to a tire or an accessory not attributable to normal wear and tear;
Damage to the motorbike or to the property of any third party caused deliberately or recklessly by you, any other driver of the motorbike, or any pillion carried during the Rental Period;
Recovery costs when damage to the motorbike is caused deliberately or recklessly by you, any other driver of the motorbike, or any pillion carried during the Rental Period;
The cost of replacing, if lost or stolen, an accessory; and
If you have breached the Rental Agreement, a per-day loss of revenue fee is based on the estimated downtime of the motorbike.
usage restrictions:
Customers are expected to use the motorcycle responsibly and in compliance with all local laws and regulations.
The motorcycle should be used according to its official registration specifications, including adhering to its intended seating capacity. For instance, if the motorcycle is registered as a single-seat vehicle, it should only be used as such.
Usage of the motorcycle for commercial purposes (unless stated), racing events, illegal activities, or any activity that could lead to excessive wear and tear is strictly prohibited.
Customers must avoid overloading the motorcycle beyond its designated weight limit as specified in its registration and manufacturer guidelines.
Any modifications to the motorcycle that violate its registration, safety standards, or legal requirements are prohibited.
Violation of these usage restrictions may result in penalties, additional fees, or termination of the loyalty program agreement.
payment for fines and tolls:
Customers are responsible for paying any fines, penalties, or citations incurred during the rental period. MotoPapi will not bear the cost of fines resulting from the customer's actions.
Similarly, customers are accountable for paying tolls as required while using the motorcycle. Tolls should be paid in accordance with the applicable toll regulations.
In the event that MotoPapi receives a toll demand on behalf of the customer, additional administrative fees will be applied to cover processing and handling costs.
Failure to promptly pay fines, tolls, or any associated administrative fees may result in additional charges, suspension of services, or consequences outlined in the agreement
termination:
Either party may terminate this agreement in case of a breach of terms, non-payment, or violation of usage restrictions. In such cases, the company reserves the right to repossess the motorcycle.
early termination:
Customers may choose to terminate the agreement early, subject to the terms of the separate payment contract. In the event of early termination, you are not entitled to any refund of monies paid to MotoPapi. Early termination may involve certain fees and conditions.
transfer of agreement:
Customers may not transfer or assign this agreement to another party without the company's written consent.
Return of Motorcycle, Breach of Terms, and Inspection:
In the event of a breach of terms or if you choose to terminate the agreement, you must promptly return the motorcycle to us. Prior to return, the motorcycle will be subject to an inspection to assess its condition. Failure to return the motorcycle or allow the inspection will result in us notifying the police, and you will be liable for all fees and costs incurred as a result of this action.
DISCLAIMER OF WARRANTIES:
MotoPapi reserves the right to confiscate the motorbike at any time without notice in the event of your breach of the Rental Agreement or if the motorbike sustains any damage or if continuing to use the motorbike could adversely affect the motorbike or its engine. By agreeing to this, you release MotoPapi, its employees, agents, and related parties from any claims, demands, and damages of any kind and nature, whether known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way connected with any disputes between you and MotoPapi relating to any rental bikes or other equipment.
INDEMNIFICATION:
You agree to indemnify, defend, and hold harmless MotoPapi and its Providers, along with their officers, directors, employees, affiliates, agents, licensors, and suppliers, from any losses, expenses, damages, and costs, including reasonable attorney fees, resulting from your violation of these Terms.
LIMITATION OF LIABILITY
You explicitly acknowledge and agree that neither MotoPapi nor its directors, nor any of their respective employees, shall be responsible or held liable to any individual or entity for any form of loss, damage (be it actual, consequential, punitive, or otherwise), injury, claim, liability, or any other cause of any kind or nature whatsoever arising from or associated with the rental of any motorcycle from MotoPapi. By way of illustration and without limiting the generality of the foregoing, MotoPapi and affiliated individuals and entities shall not bear responsibility or liability for any claim or damage arising due to the failure of performance or non-performance in the operation of the motorcycle.
Under no circumstances shall MotoPapi's liability concerning or arising from the rental of any motorbike or other equipment exceed the applicable rental reservation deposit fee that has been actually paid to MotoPapi. This limitation of liability section applies regardless of whether the alleged liability arises from contract, tort, negligence, strict liability, or any other basis, even if MotoPapi has been advised of the possibility of such damage. This limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.
GOVERNING LAW:
These Terms of Use for the Rental Agreement are governed by the laws of the state of Queensland. By using MotoPapi's services, you agree that any disputes will be exclusively resolved within the jurisdiction of the Courts located in Queensland. If any part of these Terms of Use is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that specific provision will be treated separately while the remaining provisions remain valid. MotoPapi's failure to insist upon or enforce strict performance of any provision in these Terms will not be interpreted as a waiver of that provision or right.
Entire Agreement:
The provisions and terms outlined in these Terms, along with each referenced obligation, constitute the complete Agreement between MotoPapi, its affiliated or related entities, and you. This agreement supersedes any previous agreements or understandings not included here. If any discrepancies arise between these Terms and any future published terms of use or understandings, the most recent published Terms or terms of use or understanding will take precedence.

Unless context suggests otherwise, in these Terms, "us," "we," and "our" refer to MotoPapi. The terms "User," "You," or "Your" pertain to the individual(s) participating in the Rental Agreement. The term "motorbike" pertains to the motorbike under contract.

Failure to return the motorcycle or allow the inspection will result in us notifying the police, and you will be liable for all fees and costs incurred as a result of this action.
DISCLAIMER OF WARRANTIES:
MotoPapi reserves the right to confiscate the motorbike at any time without notice in the event of your breach of the Rental Agreement or if the motorbike sustains any damage or if continuing to use the motorbike could adversely affect the motorbike or its engine. By agreeing to this, you release MotoPapi, its employees, agents, and related parties from any claims, demands, and damages of any kind and nature, whether known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way connected with any disputes between you and MotoPapi relating to any rental bikes or other equipment.
INDEMNIFICATION:
You agree to indemnify, defend, and hold harmless MotoPapi and its Providers, along with their officers, directors, employees, affiliates, agents, licensors, and suppliers, from any losses, expenses, damages, and costs, including reasonable attorney fees, resulting from your violation of these Terms.
LIMITATION OF LIABILITY
You explicitly acknowledge and agree that neither MotoPapi nor its directors, nor any of their respective employees, shall be responsible or held liable to any individual or entity for any form of loss, damage (be it actual, consequential, punitive, or otherwise), injury, claim, liability, or any other cause of any kind or nature whatsoever arising from or associated with the rental of any motorcycle from MotoPapi. By way of illustration and without limiting the generality of the foregoing, MotoPapi and affiliated individuals and entities shall not bear responsibility or liability for any claim or damage arising due to the failure of performance or non-performance in the operation of the motorcycle.
Under no circumstances shall MotoPapi's liability concerning or arising from the rental of any motorbike or other equipment exceed the applicable rental reservation deposit fee that has been actually paid to MotoPapi. This limitation of liability section applies regardless of whether the alleged liability arises from contract, tort, negligence, strict liability, or any other basis, even if MotoPapi has been advised of the possibility of such damage. This limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.
GOVERNING LAW:
These Terms of Use for the Rental Agreement are governed by the laws of the state of Queensland. By using MotoPapi's services, you agree that any disputes will be exclusively resolved within the jurisdiction of the Courts located in Queensland. If any part of these Terms of Use is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that specific provision will be treated separately while the remaining provisions remain valid. MotoPapi's failure to insist upon or enforce strict performance of any provision in these Terms will not be interpreted as a waiver of that provision or right.
Entire Agreement:
The provisions and terms outlined in these Terms, along with each referenced obligation, constitute the complete Agreement between MotoPapi, its affiliated or related entities, and you. This agreement supersedes any previous agreements or understandings not included here. If any discrepancies arise between these Terms and any future published terms of use or understandings, the most recent published Terms or terms of use or understanding will take precedence.

By entering into a rental loyalty program agreement for a motorbike with us, you are accepting and agreeing to these Terms. Once you initiate a loyalty program arrangement with us, these Terms establish a legally binding contract between you and MotoPapi. At our sole discretion, we retain the right to modify, alter, or update these Terms at any time. Such modifications will take effect once the revised Terms are forwarded to you. Unless context suggests otherwise, in these Terms, "us," "we," and "our" refer to MotoPapi. The terms "User," "You," or "Your" pertain to the individual(s) participating in the Rental Agreement. The term "motorbike" pertains to the motorbike under contract.
TERMS AND CONDITIONS
Eligibility and Agreement Acceptance:
You must meet the following eligibility criteria to participate in the loyalty program:
Possess and maintain a valid driver's license issued in Australia or their home country.
For international driver's licenses not issued in English, customers must provide an officially translated copy in English.
Provide a valid copy of their passport for identification purposes
Provide valid contact information as required by the company.
Rental Period:
The rental period commences on the date of motorcycle delivery and continues until the full ownership transfer takes place, subject to the payment terms mentioned in a separate contract.
Ownership Transfer:
Ownership of the motorcycle will be transferred to you upon completion of the agreed payment terms outlined in the separate contract.
Maintenance and Repairs:
You are responsible for ensuring the regular maintenance and servicing of the motorcycle.
MotoPapi will carry out necessary servicing and maintenance at scheduled intervals during the rental period free of charge.
Repairs resulting from normal wear and tear will be covered by MotoPapi.
Repairs necessitated by damages caused by improper use and operation of the vehicle, accidents, or negligence will be your responsibility.
You should promptly report any issues or required repairs to MotoPapi to ensure timely resolution.
Improper use includes but is not limited to, reckless driving, participating in races, overloading, or using the motorcycle for purposes other than its intended use.
Any repairs required due to improper use will be billed to you, and the terms of the loyalty agreement may be affected.
Insurance:
The motorcycle will be covered by compulsory third-party insurance provided by MotoPapi during the rental period.
MotoPapi will cover the insurance fees associated with the insurance coverage.
DAMAGE/ACCIDENT:
You are responsible for all costs of any description, including all applicable insurance excesses arising out of damage to or loss of the motorbike or any equipment, together with the cost of any damage caused by you to a third party. You are also responsible for all recovery costs (i.e., towing, salvage), and any recovery costs incurred by you will be additional to any damage excess we charge.
If damage is caused by the misuse or abuse of the motorbike in our opinion, or you are in breach of these Terms or the Rental Agreement, you will be liable for the Rental Charges for the remainder of the unexpired hire period, together with all repair costs, replacement parts, and recovery of the motorbike.
In the event you are involved in an accident, you must obtain details of all parties involved, including name, address, driver's license numbers, and insurance details (if they are available). You agree to provide all assistance reasonably required, including the provision of statements or documents. You will attend court to give evidence as required and meet with our lawyers in relation to any legal action arising in connection with your rental of the motorbike.
Regardless of the circumstances of the accident, you will not admit liability to any other parties of the accident for any reason.
You must notify the police if required under the relevant road rules.
You must not leave the motorbike unattended before the arrival of a tow truck or salvage operator except if your health or safety would otherwise be endangered.
You must complete and return an Incident Report Form, which we will provide to you.
You are responsible for the cost of tire replacement in the event of a puncture or any damage outside wear and tear.
loss damage waiver:
You are liable for:
Loss of and all damage to the motorbike and;
All damage to the property of any person, which is caused by you or any person that you allow to ride the motorbike,
or is caused by the use of the motorbike by you or any person that you allow to ride the motorbike.
Subject to the terms of this waiver, we will waive your liability for damage to, or loss of, the motorbike and will ensure that you and any Authorized Driver are entitled to be indemnified under our Insurance Policy with the full payment of the Excess amount for each separate event involving:
Damage to, or loss of, the motorbike; or
Damage to the property of any third party which is caused by the use of the motorbike by you or any person that you allow to ride the motorbike.
Additional amounts payable:
In addition to the waiver, you must always pay us the following costs and fees, including the cost of repairing or recovering any:
Water damage to the motorbike;
Damage to the motorbike or to the property of any third party caused by a breach of this rental agreement;
Damage to a tire or an accessory not attributable to normal wear and tear;
Damage to the motorbike or to the property of any third party caused deliberately or recklessly by you, any other driver of the motorbike, or any pillion carried during the Rental Period;
Recovery costs when damage to the motorbike is caused deliberately or recklessly by you, any other driver of the motorbike, or any pillion carried during the Rental Period;
The cost of replacing, if lost or stolen, an accessory; and
If you have breached the Rental Agreement, a per-day loss of revenue fee is based on the estimated downtime of the motorbike.
usage restrictions:
Customers are expected to use the motorcycle responsibly and in compliance with all local laws and regulations.
The motorcycle should be used according to its official registration specifications, including adhering to its intended seating capacity. For instance, if the motorcycle is registered as a single-seat vehicle, it should only be used as such.
Usage of the motorcycle for commercial purposes (unless stated), racing events, illegal activities, or any activity that could lead to excessive wear and tear is strictly prohibited.
Customers must avoid overloading the motorcycle beyond its designated weight limit as specified in its registration and manufacturer guidelines.
Any modifications to the motorcycle that violate its registration, safety standards, or legal requirements are prohibited.
Violation of these usage restrictions may result in penalties, additional fees, or termination of the loyalty program agreement.
payment for fines and tolls:
Customers are responsible for paying any fines, penalties, or citations incurred during the rental period. MotoPapi will not bear the cost of fines resulting from the customer's actions.
Similarly, customers are accountable for paying tolls as required while using the motorcycle. Tolls should be paid in accordance with the applicable toll regulations.
In the event that MotoPapi receives a toll demand on behalf of the customer, additional administrative fees will be applied to cover processing and handling costs.
Failure to promptly pay fines, tolls, or any associated administrative fees may result in additional charges, suspension of services, or consequences outlined in the agreement
termination:
Either party may terminate this agreement in case of a breach of terms, non-payment, or violation of usage restrictions. In such cases, the company reserves the right to repossess the motorcycle.
early termination:
Customers may choose to terminate the agreement early, subject to the terms of the separate payment contract. In the event of early termination, you are not entitled to any refund of monies paid to MotoPapi. Early termination may involve certain fees and conditions.
transfer of agreement:
Customers may not transfer or assign this agreement to another party without the company's written consent.
Return of Motorcycle, Breach of Terms, and Inspection:
In the event of a breach of terms or if you choose to terminate the agreement, you must promptly return the motorcycle to us. Prior to return, the motorcycle will be subject to an inspection to assess its condition. Failure to return the motorcycle or allow the inspection will result in us notifying the police, and you will be liable for all fees and costs incurred as a result of this action.
